Short Sale VS Foreclosure

1.  .       The ability to obtain a mortgage in the future

 1.-  In a foreclosure homeowners may have to wait up to 7  years to qualify for home loan

in a short sale the homeowner will be able to qualify as longest they are able to meet some criteria.

2. Short so many times will have less of an effect in your credit score versus the foreclosure which may bring your FICO score to less, is then shown that with a short sale your  credit score can be affected with as little as 50 points and in some cases in the little or no change in your credit score.  Credit wise if the reported as paid as agreed or paid as negotiated you will usually remain in your credit from 2 to 3 years.

If foreclosure is reported in your credit score it will last seven years and the foreclosure will remain forever as part of public records. 

3.   When it comes to security be clearances foreclosures will almost have a negative effect.  Short sales on their own will rarely have an effect on your clearance. What people don’t understand is that security clearance is needed in many industries around the country not only the military but public servants and government agencies will need it even certain areas of telecommunications and software development will also need.

4. As employers more and more check the employee backgrounds a foreclosure may have a very negative effect in your job. Especially when trying to apply for higher position or brand-new job. Since short sales are not reported on a credit report they go unnoticed by the employer.

5. There is nothing so aggravating that knowing that your home was lost in a foreclosure in the lender is looking to sue you for the amount of what is owed on the foreclose,   when you foreclose on the property that right is forfeited in most of the states. As if you short sale that is been taken care from the beginning and no deficiency judgment will apply because lender will settle with what’s owed.

Foreclosure settlement cash a few months away

Several Million of Homeowners will be contacted within the next few months to receive payment under the Foreclosure abuse settlement between the Federal Regulators and 10 large banks ! 
This disposition is according to the Federal Reserve.

Eligible borrowers, including homeowners in the foreclosure process during 2009 or 2010, will not be required to prove wrongdoing with their mortgage or take any further action, Barbara Hagenbaugh, a spokeswoman for the Federal Reserve, said Tuesday. Eligible homeowners will receive payment even if they did not previously apply for a foreclosure review.

Here's a quick tally sheet on what the new legislation could mean for you as a buyer, seller or owner.

• Do you, like millions of Americans, pay mortgage insurance premiums or guarantee fees on anFHA, VA, Fannie Mae, Freddie Mac or Rural Housing loan? The American Taxpayer Relief Act — the fiscal cliff compromise bill — allows you to write off the insurance premiums you paid during 2012 along with your mortgage interest, provided your household income does not exceed $110,000. Legal authorization for this deduction expired at the end of 2011. But the new bill retroactively permits write-offs for 2012 and 2013 for qualified borrowers.

LOS ANGELES (Jan. 7) – In an effort to conform state law to a federal law passed last week that extended mortgage debt forgiveness, the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) is sponsoring Senate Bill 30, so that California homeowners on the brink of foreclosure can get much-needed debt relief.

SB 30 (Calderon, D-Montebello) will for one more year exempt the taxation of mortgage debt that is forgiven when homeowners and their mortgage lenders negotiate a short sale or loan modification (including any principal reduction).

“We applaud Senator Ron Calderon for acting so quickly on an issue that’s critical to the housing market,” said C.A.R. President Don Faught.  “We urge the California Legislature to also act quickly and pass a measure that will give hope to tens of thousands of California homeowners and provide the vital financial relief they need in order to make important personal financial decisions.”
