So what’s happening next, 2013 is almost here!

Many people are talking about the Fiscal Cliff, also about the in MID and last but not least the debt forgiveness act.
According to the experts president Obama still discussing what it’s going to be done about the fiscal Cliff.  This week President Obama is addressing Congress. For more info  click here.



When he comes to the MID talks are still on the table with Congress are discussing perhaps an extension or a new more updated version of it. See below for report and also how to fix action.


The debt forgiveness act many talks have been around this particular topic because without it there chances that people will wind up owing money to the government because of capital gains. There is no reason why to worry yet because back in February Pres. Obama was trying to enact a new bill (FY2013) which integrated the debt forgiveness act as part of it, if this happens to pass then many things will be taking care of. How about the New TOS' of instagram 



 Just recently my wife came across this very interesting blog.  It is  talking about instagram and especially the blogger was talking about the new TOS ever since it was bought by Facebook.   
The new TOS is based on the fact that everything you post from writing and pictures all will become part of their revenue making items. Which it’s interesting because any picture you put on becomes theirs! 
I feel is not really fair because the moment you take a nice picture and they like it the TOS   says that they can market it sell it and pocket that money without you even knowing or getting a penny from it.

I want to say thanks.




 I just recently discovered this thank you note on a closing I did a little while back.  It was not a very easy file and while lending had some issues, things end up on a very happy note and a client that I know they had a very great experience and end up with a very nice property.

Now that we’re in the season of being thankful and joyful, I would like to think back and think of every single client that he has given me the chance to be able to make their dream come true and for some a better future on a situation that was very negative.   Also I would like to thank my family especially my wife for putting up with me sometimes when I was on appointments very late at night and my kids which in turn they were waiting for daddy to get home.
I feel this year was full of learning and full of blessings, some bumps on the road and great strides were made for an awesome 2013.

In our profession sometimes because everything goes so fast we don’t have the time to thank everyone that walks with us and comes along the way.

MORTGAGE INTEREST DEDUCTION

The question is whether it will stay or it will go? Many people leaves it to Congress and we think they will make the right decision for all of us!  But at this time government is neither pushing it nor ignoring the MID (mortgage interest redone deduction) and we don’t want Congress just sit on it and do nothing!  Many lawyers say “it depends”.  I would say no one really knows.  But if we don’t take action then we will deserve what we all get! 
As realtors this is very important and as a homeowner should be very important for you too.  The MID (mortgage interest redone deduction) is something you should take very seriously as a homeowner.
You may wonder how much money is involved. The cost to the feds in 2013 is around $97 Billion. 
The number one in size of deductions is California at around $18,000.00 the lowest state is Oklahoma with an amount of $8,000.00.   The Mid-America states are not as affected because they are able to use extended deduction.
At this point we ask you to take some time and urge you to call your representative in congress and let them know how important this decision on the MID (mortgage interest redone deduction)   is for you too!

I don’t think I have a big enough hardship to qualify for a short sale.
Now a days qualifying for a short sell is a lot simpler than before banks have understood that homeowners are real people and then their hardship could come in various ways. As longest is something real that is causing you a big problem to pay your mortgage whether is long-term or short then you may qualify for a short sell. Mortgage forgiveness debt relief act of 2007
Many of our clients have asked if this act will happen to be extended.
As a reminder this legislation ensures that homeowners who received principal reductions or other forms of debt forgiveness on their primary residences do not have to pay taxes on the amount forgiven,  without it the debt forgiven on a loan modification or short sales will qualify as income that is taxable to the borrower.
 In order to avoid that, you would have to presently close that loan modification or  the short sale on or before December 31st 2012.
A few months back DSnews reported:
“Obama’s FY2013 budget proposal includes an extension of the Mortgage Forgiveness Debt Relief Act of 2007…  
In the Treasury’s Green Book, its summary explanation of the administration’s budget proposal, it calls for an extension of the tax break due to “the continued importance of facilitating home mortgage modifications.”
The administration is proposing an extension that would apply to any amounts forgiven before January 1, 2015.”

In today’s date this could mean a great help for all the homeowners that have a pending loan modification or short sale.  This budget proposal could be considered doubtful and both parties would have to agree of this agreement be extended we can in the hope that Congress get their act together and passes this provision.

Background
Congress, as part of negotiations on avoiding the "Fiscal Cliff," has made direct references to "closing loopholes" and "limiting deductions" as a way to raise revenues. Clearly, the mortgage interest deduction is high on this list of revenue raisers.
Losing the Mortgage interest deduction will disproportionately affect the middle class because a larger proportion of the middle class takes the deduction. In California 89% of those who took the mortgage interest deduction earned less than $200,000. Losing the deduction would cost the average California taxpayer over $3,900.

Keep in Mind we all are in this together !!!  

What your family, friends and clients can do to help:
Call Congress. First and foremost, we are urging the public to get involved by calling Congress to ask that the mortgage interest deduction be preserved. The public may reach Congress by calling202-224-3121. The Capitol switchboard operator will help callers identify their member of Congress and connect them.

Get the word out. Many people seem to be blissfully unaware that their mortgage interest deduction is in danger. Please do the following to make sure that the message spreads.

Why not be foreclosed? Why sell short?

  • Have your chances of Improving the eligibility for a government insured loan – In a Foreclosure you will be ineligible for a Government insured loan for 5-7 years (only two if you Short Sale.  A foreclosure will remain in your credit report and that is an item that is very impossible to take out of it!  
  • Stop and Avoid a deficiency judgment – Lenders have the right and they can seek deficiency judgement against the home owner and they can collect the amount owed to them that was not recover at the sale!   
  • Protect your future employment  prospects – Many employers are requiring credit checks on their new prospect employees.  Government clearance will be put at risk by a Foreclosure,  Many employers will run credit background checks on  prospective employees. Foreclosure is one of the top items that will put a potential new hire, or even current employment, in jeopardy.
